Freedom of Information Act 2000

The Freedom of Information Act 2000 (FOI) came into force in January 2005 and allows for requests to access information to be made which is not already available to the public.

Publication Scheme

East Riding of Yorkshire Council has adopted the Information Commissioner's Model Publication Scheme which sets out the council's commitment to make information available.

The scheme sets out the classes (types) of information which is available and which is identified in the council's 'guide', (the guide being the main council website).

The guide gives details of the information that the council publishes or intends to publish; how the information is published; and whether a charge is payable.

Where information is not listed in the guide any individual or organisation can, under the Act's general right of access, ask to have access to any information held by the council.

Requesting Information

Important note: The council will not disclose exempt information but will make available non-exempt information within the same class of information.

A general right of access request will be acknowledged within two days of receipt.

A full response will be given within twenty working days from receipt of sufficient information to reply to the request.

Is There a Cost Involved?

There may be a charge to cover disbursements.

These are photocopy and postage costs, and costs to produce information in preferred formats.

A calculation will be made for administrative time in meeting a request for information which is not routinely published (i.e not listed in the council's guide).

If this cost exceeds 450 (18 hours of officer time) it is at the council's discretion as to whether it discloses the information requested.

Certain information may be exempt from disclosure.
